Terms of service

These Terms of Service ("Terms") govern your use of hydrateyourpotential.ca, hydrateyourpotential.com and shop.hydrateyourpotential.ca (together, the "Sites") and any purchase you make from 1073034 BC Ltd, doing business as Liquid Life ("Liquid Life", "we", "us" or "our"). By using the Sites or placing an order, you agree to these Terms. If you do not agree, please do not use the Sites.

1. Eligibility and accounts

You must be at least the age of majority in your province or territory, or have a parent or guardian's permission, to place an order. You are responsible for keeping your account details secure and for the accuracy of the information you give us.

2. Products and descriptions

We try to describe and display our products accurately, but colours, images and packaging may vary slightly. Our products are purified bottled water for general hydration. Nothing on the Sites is medical advice or a claim that our products treat, cure or prevent any disease.

3. Prices and taxes

All prices are in Canadian dollars. Applicable taxes (such as GST/HST and PST) and shipping charges are calculated and shown at checkout. We may change prices at any time, but changes will not affect orders already confirmed. If a product is listed at an incorrect price because of an error, we may cancel the order and refund any amount paid.

4. Orders and availability

Your order is an offer to buy. We accept it when we ship the products or send a shipping confirmation. Products are subject to availability, and we may limit quantities or refuse or cancel any order (for example, for suspected fraud, pricing errors or stock issues). If we cancel an order after payment, we will refund you in full.

5. Payment

Payment is taken at checkout through our payment providers. By placing an order, you confirm you are authorized to use the payment method provided.

6. Subscriptions

Subscriptions renew automatically and are charged to your payment method each billing period until you cancel. You can pause, skip or cancel at any time before your next billing date. Full details are in our Subscription Cancellation Policy, which forms part of these Terms.

7. Shipping, returns and refunds

Shipping is governed by our Shipping Policy, and returns and refunds by our Return and Refund Policy. Both form part of these Terms. Risk of loss passes to you when the carrier marks your order as delivered.

8. Use of the Sites

You agree not to misuse the Sites, including by attempting to gain unauthorized access, interfering with their operation, using automated tools to collect data, or using them for any unlawful purpose.

9. Intellectual property

All content on the Sites, including the Liquid Life and Hydrate Your Potential names, logos, text, images and designs, belongs to us or our licensors and is protected by law. You may not copy, reproduce or use it without our written permission.

10. Disclaimer

To the extent permitted by law, the Sites and their content are provided "as is" and "as available", without warranties of any kind. We do not guarantee that the Sites will be uninterrupted or error-free. Nothing in these Terms excludes any warranty or right that cannot be excluded under applicable consumer protection law.

11. Limitation of liability

To the extent permitted by law, Liquid Life and its directors, officers, employees and agents are not liable for any indirect, incidental, special or consequential damages arising from your use of the Sites or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. This does not limit liability that cannot be limited by law.

12. Indemnity

You agree to indemnify us against claims, losses and expenses arising from your breach of these Terms or misuse of the Sites.

13. Privacy

Our Privacy Policy explains how we handle your personal information and forms part of these Terms.

14. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. You agree to the jurisdiction of the courts of British Columbia, except where the consumer laws of your province give you the right to bring a claim where you live.

15. Changes to these Terms

We may update these Terms from time to time. The version posted on the Sites at the time of your order applies to that order.
